The “illy Taste of New York Experience” Sweepstakes (the “Sweepstakes”) begins 12:00:01 a.m. Eastern Time (“ET”) on September 15, 2008 and ends 11:59:59 p.m. ET on November 14, 2008 (“Sweepstakes Period”).

ELIGIBILITY: Sweepstakes is open to legal residents of 50 United States and District of Columbia, 21 years of age or older as of date of entry. Employees of illy caffè North America, Inc. (“Sponsor”), or any of its’ parent and affiliated companies, subsidiaries, advertising and promotional agencies and any and all other companies associated with the Sweepstakes and their respective employees, agents, officers, directors, and their immediate families (parent, siblings, children and spouse) and persons residing in the same household (whether related or not) of such employees are not eligible to enter or win. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, anywhere else outside of the U.S. and where prohibited, taxed or restricted by law. By entering, entrants acknowledge compliance with these Official Rules available at www.tasteilly.com. Subject to all federal, state and local laws.

HOW TO ENTER: You may submit your sweepstakes entry in two ways:

1: ONLINE & FREE ENTRY METHOD: You may enter the Sweepstakes online at www.tasteilly.com. Consumers are required to complete the following information: full name, complete mailing address, email address, daytime phone, age, answer to the illy trivia question and answers to survey questions. Consumers with correct and incorrect answers to the trivia question will be eligible to be included in the random drawing for prizes. All online entries must be received no later than 11:59:59 PM ET on November 14, 2008.

2: TEXT ENTRY METHOD: Send a text message with the designated keyword from your handset to the shortcode 94444. Designated keywords can be found at participating events, retailers, restaurants and hotels where illy coffee or products are promoted or sold. Click here for a full list of participating establishments and events. Once you have sent the text message, you will receive a confirmation message thanking you for entering the Sweepstakes. All text entries must be received no later than 11:59:59 PM ET on November 14, 2008. If you opt out at any time by sending the word “STOP” to 94444 you will no longer be eligible to enter the Sweepstakes. Standard text messaging rates apply to each text message sent or received and other charges may also apply as provided in your wireless service rate plan. All entries, regardless of entry method, must be received no later than the end of the Sweepstakes Period. All text messaging entrants must have a text messaging two-way capable handset and digital service in order to enter the Promotion using the text messaging method. Text messaging service is not available in all areas.

Entries are limited to one entry per person per email address or mobile telephone number (“MTN”) per week, regardless of the method of entry. Entries in excess of weekly limit are void. All entries become the property of Sponsor and will not be acknowledged or returned. All entries become the sole property of Sponsor and receipt of entries will not be acknowledged or returned. Promotion Entities (defined below under “GENERAL RULES”) are not responsible for lost, late, incomplete, invalid, unintelligible, garbled or misdirected entries, all of which will be disqualified.

All other forms of entry are void. To be valid, each entry must be completely filled out as noted above. Entries are void if mechanically reproduced, defective, altered, forged or submitted through or outside authorized channels, made through robotic, automatic, mechanical, facsimile, programmed or similar entry duplication method, and Sponsor reserves the right to disqualify any individual using such method. Sponsor reserves the right in its sole discretion to disqualify any entry at any time which, in Sponsor’s opinion, the entrant has not complied with these Official Rules.

RANDOM DRAWING: Prizes will be awarded in a random drawing conducted by Marden-Kane, Inc., an independent judging organization on or about November 20, 2008, from among all eligible entries received. Odds of winning a Prize depends upon the total number of eligible entries received. Decisions of the judges will be final and binding on all matters relating to this Sweepstakes.

PRIZES: One (1) Grand Prize: A three (3)-day/two (2)-night trip for winner and guest to New York City. Trip includes roundtrip coach airline tickets from major gateway airport nearest Winner’s home, five-star hotel accommodations for two (2) nights (double occupancy) in New York City, ground transportation between the airport and hotel, meet & greet service in New York. Planned activities include attending the opening night of the New York Film Festival, first class dining at Tribeca Grill and Le Bernardin Restaurants, two tickets to the Guggenheim Museum and one VIP pass for two people to the Museum of Modern Art (MOMA), weekend passes for complimentary servings of illy at New York City cafes, $1,000 spending money and The Francis Francis X7 iperEspresso machine plus a case of coffee capsules. Approximate Retail Value (ARV): $4,500.

Actual value may vary based on travel dates and Winner's point of departure. Any difference between approximate value and actual value of the trip will not be awarded in cash. If Winner lives within a one hundred (100)-mile radius of Prize destination, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for any difference in Prize value. Should any portions of the Grand Prize be cancelled, postponed or in any way abbreviated after ticketing of trip, including but not limited to the cancellation of the New York Film Festival, Sponsor shall have no liability or further obligation to the Winner other than to supply the remainder of the Grand Prize trip as described, with no further compensation being paid in exchange therefore. Terms and conditions will apply to the Guggenheim and MOMA museum passes, and the New York Film Festival tickets.

Grand Prize trip must be taken at time and flight itinerary specified by Sponsor in Sponsor's sole discretion or Prize will be forfeited in its entirety and a replacement Grand Prize Winner will be selected from among the remaining Eligible Entries. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. All travel dates are subject to change in Sponsor’s sole discretion. Air travel and hotel accommodations are subject to availability and any changes made to either of these will be at the expense of the Winner. Winner and guest will be required to travel together on the same itinerary and be responsible for obtaining all required travel documents (photo identification). Winner and guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Guest traveling with Winner must be the age of majority in the jurisdiction in which he/she resides at time of trip fulfillment, or guest must be a family member of Winner. No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of Sponsor. Travel is subject to the terms and conditions set forth in this Promotion, and those set forth by Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. Lost or stolen airline tickets will not be replaced or exchanged.

Five (5) First Prizes: A case of illy coffee (6 cans fine grind medium roast) (ARV: $78 each)

Ten (10) Second Prizes: 6 piece illy espresso cup and saucer sets (ARV $30 each).

Total ARV of all prizes: $5,190. Limit one prize per person. All prizes will be accepted by winner “as is”. Cash cannot be substituted for any prize unless otherwise agreed by the Sponsor. Lost or stolen prizes will not be replaced or exchanged.

GENERAL RULES: All prizes will be awarded. Prizes are non-transferable, and no substitutions or cash equivalents allowed, except at the discretion of the Sponsor. If a prize is unavailable, a prize of equal or greater value will be awarded in Sponsor’s sole discretion. All taxes on prize and other expenses related to accepting and/or using prize not listed in these rules, are the sole responsibility of the winner. Potential Grand Prize Winner will be required to complete and return an affidavit of eligibility and liability/travel release and publicity consent (except where prohibited by law) within ten (10) days of date specified on prize notification, sent by Federal Express overnight delivery. Failure to do so will result in disqualification and the selection of an alternate winner from remaining eligible entries. Upon prize forfeiture, no compensation will be given. The value of the Grand Prize will be taxable to Winner as income. Grand Prize Winner must supply Sponsor with his/her social security number for tax purposes. An IRS Form 1099 will be issued in the name of Winner for the actual value of the Prize received. Entrants release and hold harmless the Sponsor, its parent, subsidiaries, partners, advertising and promotional agencies and employees of these companies (“Promotion Entities”) from any and all liability, claims, losses, actions, damages, injuries, or losses of any kind that may result from participation in the sweepstakes, or the acceptance, possession, use, misuse, or non-use (including any travel or travel-related activity thereto of the prize that may be awarded) of any prize. By entering, entrants agree that they will have no rights to bring (and covenant not to bring) any claim, action or proceeding of any kind or nature whatsoever against Promotion Entities. By accepting prize, winners grant permission to use their name, city, state, prize information, descriptions, photograph, voice, likeness, statements, and biographical information without limitation, for advertising and publicity purposes on Sponsor’s website and other promotional materials, without further compensation, except where prohibited by law. Promotion Entities are not responsible for any lost, stolen, corrupted, undecipherable, misdirected or otherwise unaccounted for entries that may arise from technical errors in hardware and software programs. Sponsor has the sole right to cancel or suspend the promotion or any portion thereof for any reason whatsoever that may corrupt the administration, security or proper play of the promotion. In such cases, prizes will be awarded from all eligible entries received prior to cancellation. All federal, state, and local laws and regulations shall apply. In the event that any winner is not in compliance with the rules or is unable to be notified within ten (10) days of drawing, the prize will be forfeited and an alternate winner will be randomly selected from all of the remaining qualified entries. Upon prize forfeiture, no compensation will be given. Sponsor is not responsible for printing or other errors in these Official Rules or any promotion materials.

INTERNET: If you send your entry via text message, then you must have a valid MTN and account and the Prize will be awarded to the name corresponding to the MTN from which the text message originated. "Authorized Account Holder" is defined as the natural person who is assigned a MTN by the wireless carrier or as shown on the billing records of the wireless carrier. The potential Winner may need to present a wireless bill to confirm his/her status as the Authorized Account Holder of the wireless account used to text message the winning entry. If you send your entry online, the Prize will be awarded to the authorized account holder of the e-mail account specified in the entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Each potential Winner will be notified by email or MTN, depending upon method of entry. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission or communications line failure that results in Entry forms being inaccessible online. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this sweepstakes or downloading any materials in this sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL & CIVIL LAWS & SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
